Terms and Conditions
Introduction
These terms and conditions (Terms) govern the provision of nutrition consultation services (Services) by Olivia Shuttleworth of Optimal Health (Consultant) to you (Client). By engaging in our Services, you agree to be bound by these Terms. Please read them carefully.
Scope of Services
The Services provided by the Consultant involve nutritional therapy consultations aimed at providing dietary advice, meal planning, lifestyle recommendations and potentially a nutritional supplement programme tailored to the Client's individual needs.
Nutritional therapy is the application of nutrition and lifestyle medicine sciences in the promotion of health, peak performance, and individual care. Nutritionists assess and identify potential nutritional imbalances and understand how these may contribute to an individual’s symptoms and health concerns. This approach allows them to work with individuals in a personalised manner to address nutritional imbalance and help support the body towards maintaining health.
Nutritionists never recommend nutritional therapy as a replacement for medical advice and always refer any client with 'red flag' signs or symptoms to their medical professional. They frequently work alongside medical professionals and other healthcare professionals involved in the client's care to explain any nutritional therapy programme that has been provided.
The Client acknowledges the following:
The degree of benefit obtainable from nutritional therapy may vary between clients with similar health concerns and following a similar nutritional therapy programme.
Nutrition and lifestyle recommendations will be tailored to support health conditions and/or health concerns identified and agreed between the Consultant and the Client.
The Consultant cannot and will not diagnose, or claim to treat or cure, medical conditions.
The Consultant’s recommendations are not a substitute for professional medical advice and/or treatment.
The Consultant may recommend food supplements and/or testing as part of the Client’s nutritional therapy programme and may receive a commission on these products or services.
The Client understands and agrees to the following:
I agree to provide accurate and complete information regarding my medical history, dietary habits, lifestyle, and any other relevant information necessary for the provision of the Services.
I will tell the Consultant about any medical diagnosis, medication, herbal medicine, or food supplements I am taking as this may affect the nutritional programme.
I am responsible for contacting my GP about any health concerns.
If I am receiving treatment from my GP, or any other healthcare provider, I will tell him/her about any nutritional recommendations provided by the Consultant. This is necessary because of any possible reaction between medication and the nutritional programme.
If I am unclear about the agreed nutritional therapy programme/food supplement doses/time period, I will contact the Consultant promptly for clarification.
I will contact the Consultant should I wish to continue any specified supplement programme for longer than the originally agreed period, to avoid any potential adverse reactions.
I understand that the recommendations from the Consultant are personal to me and may not be appropriate for others.
Recording consultations using any form of electronic media is not allowed without the written permission of both the Consultant and I.
Payment and Fees
The fees shall be agreed between the Consultant and the Client in advance of the consultation (Fees).
Payment of the Fees by the client is required at the time of booking a consultation.
Any additional costs incurred during the provision of the Services, such as recommended supplements, tests or resources, will be communicated to the Client and must be paid separately.
Cancellation and rescheduling
In the case of an initial or follow up consultation, the Client may cancel or reschedule a consultation by providing at least 48 hours’ notice to the Consultant. If such notice is provided, a full refund of the Fees paid will be provided to the Client. Failure to provide the required 48 hours’ notice will result in a late cancellation fee of 100% of the Fees paid.
In the case of a package deal, if follow up appointments are not used within one year from the date of the Client’s initial consultation, it will be assumed that the Client no longer requires the Services and no refund of any portion of the Fees will be provided by the Consultant.
Online or telephone consultations
It is the Client’s responsibility to ensure that they have a working internet connection for all online consultations and a working telephone connection for all telephone consultations. The Client will be charged in full for scheduled consultations where the Consultant is waiting for the client to connect online or via telephone and the Client is unable to do so.
Confidentiality
The Consultant will collect personal information of the Client that is necessary for the provision of the Services and will only use that information for the purpose for which it was collected, or as otherwise permitted by law. The Client acknowledges that providing inaccurate or incomplete personal information may affect the quality and effectiveness of the Services provided.
Client information will only be disclosed to third parties with the consent of the Client, with the exception of the following categories of third parties:
the Consultant’s registry body/professional association/insurance company for the processing of a complaint made by the Client;
any contractor and/or advisors that provide a service to the Consultant or act as the Consultant’s agent on the understanding that they keep the information confidential;
any supplement company or testing company as part of providing the Services;
the Client’s GP, the police and/or social services in the case of a child or vulnerable adult, if the Consultant believes that the Client’s or anybody else’s life is in danger;
anyone to whom the Consultant may transfer its rights and duties under any agreement with the Client;
any legal or crime prevention agencies and/or to satisfy any regulatory request; and
any other party as required by law.
The Client has the right to request access to, and correction of, their personal information held by the Consultant. Requests for access or correction should be made in writing to the Consultant.
Limitation of Liability
The Client acknowledges that the Services are provided by the Consultant for informational purposes only and are not intended to replace medical advice or treatment.
The Consultant shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of or in any way connected with the provision of the Services.
Amendments
The Consultant reserves the right to amend these Terms at any time. Any amendments will be communicated to the Client in writing.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
Acknowledgement
By engaging in the Consultant’s Services, the Client acknowledges that the Client has read, understood, and agrees to be bound by these Terms.
